Court watchers listened very closely to the questions posed by swing vote Justice Kennedy. When he said that the individual mandate "changes the relationship of the government to the individual in a fundamental way"  the air seemed to go out of the government's case  for the health care law.

It seems Justice Kennedy may be sympathetic to the goal but disagree with the means.
